Legal Question in Family Law in Texas

Grandmother manipulates courts to legally kidnap child

in a custody suit a step Grandmother bribed the dad into contesting the childs custody by promising to let the child live with her, his incentive is to not have to pay child support that he is 3500 in arrears on, and then pulls the child out of school to homeschool him AND hide him from the Mother who is a fit mother and opposed to all of the above, but it is less than 6 months since the prior modification, is there any legal recourse against the Grandmother and Father for abuse of legal procedures or negligance, anything? Please help.

Re: Grandmother manipulates courts to legally kidnap child

What do you have to prove your allegations?

What personal knowledge or evidence do you have?

I know that you will find this hard to believe but many people lie under oath on the witness stand. It is very hard to prove that someone is not telling the truth!

Forget what you see on t.v. -- Perry Mason and Judge Judy! Judges are overworked and want cases to move quickly.

My question to you:

If you got visitation and you aren't getting any, then you need to file contempt on the father.

If you live in Harris County, give me a call at 713-847-6000. Be sure to mention that you found me on lawguru.com

Best of luck!

I have the same questions that Fran had. I would also add that child support arrearages do not disappear when custody changes. If you are owed past due child support you can file to have the past due support paid. This is another contempt issue. Contempt of court means that the "defendant" known in this type of hearing as the respondent can be put in jail for failing to do what the court ordered. In a hearing where you are asking for contempt, you will also be awarded court costs and attorney fees if you are successful. Most attorneys will ask that you pay the fees prior to filing. These costs can then be added to the child support due so that you are reimbursed for the costs. Fran makes an excellent point. It is a crime to lie in court but proof is very difficult. If you are in the Dallas/Fort Worth area you are wecome to call me. I am out of state at this time but will return on Dec 13. Until then I can be reached by email. After that you can reach me at 817 821-0945. Good Luck
