Legal Question in Family Law in Texas

My grandmother is 100 years old, has dementia and is in a nursing home. My aunt currently has power of attorney but lives out of state, is in poor health, and difficult to reach in case of emergency. We need to transfer power of attorney for my grandmother or at least share it. How should we go about doing this?

If grandmother is incompetent it's too late for her to have a new power of attorney executed. You might want to talk to an estate planning or probate attorney in the county where she lives. You might want to talk to her doctor to determine if he/she feels that your grandmother is still competent to sign the necessary paperwork.

If that won't work then you might need to get a guardianship over your grandmother.
