grandparent rights
my daughter is divorced. Her children live in Dallas with their father and new step mother. My ex-son-in-law is giving me a difficult time about me seeing the kids.I live in Colorado, and have been going about every 4 months, picking up the kids and going on to New Braunfels, texas where we spent a week with their Mother, and their cousins. But he will no longer allows me to get the kids. Do I have rights as a Grand parent? Can visitation times be establised for me as their Grand parent legally? Their Mother has not been as faithful with child support as she should, but I have no control over that. I just want to be a consistant person in their lives, and the best I can be for them..

Under Texas law, it is very difficult for you as the grandparent to get any type of forced visitation, especially with your daughter still alive. I would suggest that your daughter insure that her visitation is met and that you see your grandchildren during her visitation. Failure to pay child support does not mean that visitation is lost. She gets it even if doesn't pay child support.
