Legal Question in Family Law in Texas

grandparent rights

my girlfriend and I have a son and we have worked out an agreement on the two of us visiting and spending time w/ our son. MY crazy mother is upset that we are even doing this and is threating to come take the baby and that she has grandparent rights to do so. IF me and the babies mother are doing everything in a friendly manner and what is good for our child, does crazy mother have any rights? Our papers were drawn up in loiusiana and we now live in Texas. Thanks for any help you can give me.

Re: grandparent rights

It's admirable that you and your son's mother are able to work together in your son's best interest. It is always better when parents can work out custody and visitation issues without being compelled to by a court. It seems as though your mom is well-meaning, but uninformed about the law. Generally speaking, grandparents have very limited rights. It appears from your question that your mother does not have standing (legal right) to file suits affecting the parent-child relationship and she certainly enjoys no right to take your child. Your question does not state whether the agreement was part of a custody order. If it was not, the document itself is not as important as the good will that you and your son's mom are exhibiting. If the agreement is court ordered, it can be enforced in Texas with some procedural steps. Good luck.
