Legal Question in Family Law in Texas

Grandparents Take Child From Parents and Do Not Return Child or Allow Visitation

My wifes parents took our 11 month old daughter from us about 4 months ago. They did this on the basis of THEIR thinking we did not provide a stable home for our daughter. The grandparents will not return our child and will not let us even visit her. Our daughter has always been loved and cared for. There has never been any type of physical or emotional abuse. We are a married 20 year old couple and we believe this is the reason the grandparents dont think we can take care of our daughter. We contacted the police but they said since it was a civil matter, they could do nothing about it. We have spoken with an attorney who said the grandparents have no right to have our daughter, and that we should file a Petition for Writ of Habeas Corpus. What can we do, or what should we do?? Please help??

I would definitely follow your attorney's advice if you want to obtain the return of your child.

I think the lawyer is exactly right. The only thing I would add is, the sooner the better.
