Legal Question in Family Law in Texas
Can grandparents get custody?
My son and his wiffe are seperated. She has taken their 2 yr old daughter and moved in with her boyfriend. There is no way he can get custody because of his record. CPS has been called on her 3 times. My son wants us to get custody because hse is not taking care of the baby. We have talked to one attorney but he wants $10,000 up front. We don't have that kind of money. Can you recommend someone that could help us?

Re: Can grandparents get custody?
If you look around, you can probably find an attorney
that would accept a smaller initial retainer, however
the attorney you talked to likely stated this amount because the
legal fees for a case like this (that will likely be
tried because mom probably will not give up custody
until after a full trial) can EASILY cost well over
$10,000.00. In fact, some cases going through a full
trial can cost in excess of $20,000.00. My divorce
(several years ago - before I was an attorney) cost
me $35,000.00. But I won and my son was worth every penny.
I am not attempting to scare you but let you know that
this is an area of law that will tax your finances.
You need to know that going in. I do not know of an
attorney that would guarantee the fees to be under $10,000.
Because these cases are very time-intensive and family law
attorneys bill by the hour, in my opinion an attorney would
be a fool to tell you your fees will be under $10,000.00. I
am sorry because I doubt this is what you want to here, but
I think the best you could hope for if you want to pursue
this is an attorney willing to accept a payment plan. Many
attorneys, myself included, have done these types of arrangements.
I hope this helps. Good luck!
