Grandparents Law in New Jersey & Illinois

My mother lives in New Jersey. My soon-to-be ex-wife is living, with my children, in Illinois. I am just graduated from basic training in the Army and was stationed in Texas. My wife will not let me or my mother see the children. Here is my dilema: My mother wants to file for grandparents visitation, but does she have to go through New Jersey or Illinois? Can it be put into the divorce papers for her visitation rights? If not, where does she have to file...New Jersey or Illinois? Also, what chance do I have on sole custody of my children with living in Texas and being in the Army? I haven't gotten any answer and I am hoping someone will be able to help me. It will be greatly appreciated.

Oddly, you are dealing with an area of law that is still developing in this state -- military parents and conservatorship; and granparent conservatorship. There are conflicts of law that cause a mess, and no clear cut answers.

When you say 'soon-to-be-ex-wife" I presume that a divorce action is pending somewhere -- that is the law that prevails. You need a lawyer in that county, or nearby county, to help you sort out your options.
