How do grandparents recieve custody of grandchildren?

Two ways:

1. INTERVENE. If there is a suit already pending, you can intervene in the suit and seek conservatorship.

2. ORIGINAL SUIT. If there is not suit pending, you can seek conservatorship in two ways:

(a) If the child lived with you for a 6-month period that ended not more than 90 days ago, you would have standing so file an original petition seeking conservatorship under Texas Family Code Section 102.003.

(b) Otherwise, if you can convince the court in your pleadings that the relief you seek (getting custody) is necessary to protect the children in light of their present circumstances, you have standing to file an original petition seeking conservatorship under Texas Family Code Section 102.004.
