Legal Question in Family Law in Texas

grandparent's Rights

Ok, I feel like I am running into brick walls. My ex husband is going to prison for a sex offender crime, (he pleaded guilty).I have terminated his rights. Now his mother is suing me for grandparents rights, I don't know why I can not raise my children in peace without having to worry about if she is going to send him pictures, etc...She lied to me about him being in jail and why he was there, but I found out. I have looked on mnay different sites but most say different things. He is in prison and is a sex offender. She only wants to see one of my children not both. Can someone please tell me what rights she has in the state of Texas? Thanks and GOD Bless.

Re: grandparent's Rights

Actually she has no rights because technically she is no longer the grandmother of the children. Any rights she might have had she could have exercised throught the father and now that his parental rights have been terminated, she has nothing. You better get a lawyer for this. Some judges try to do what they think is right and issue an order contrary to the above analysis.

Re: grandparent's Rights

I thought your previous posting said you were going to get his rights terminated. Terminated or not terminated?? It makes a big difference. Terminated - grandma has no rights because dad has no rights. Not terminate - grandma may have rights because dad's in jail. As I said before and as Mr. Grissom said, GET AN ATTORNEY! This is not something to take on yourself unless you want grandma to have rights to your child(ren).
