grandparent's rights

My stepson and his girlfriend broke up in April and they are expecting in July. She has a new boyfriend and has cut us out of the picture and my stepson hasn't pursued a further relationship with his unborn son. Can my husband pursue Grandparent's rights even if his son isn't paying child support?
