Grandparents rights...Where do we start?

My brother is in prison at the time being and will remain there until January. His ex-girlfriend was bringing his son around until February 2004, then she abrumptly stopped. My parents are wanting to know where to start. From researching have found out that they have the right to access. Yet, we have not found out where we should start. Are we able to find the forms at the local courthouse or is a lawyer needed to be involved. How much does such an action usually cost? Thanks.

Basically, you file a lawsuit in the county the child lives.

You will need to be able to locate the mother so that she can be "served" (notified) that there is a lawsuit pending regarding this child.

Although your grandparents may try to represent themselves, this type of case will likely require legal counsel as it will be a contested matter from the begining. A suit affecting the parent child relationship can be brought by the grandparents assuming they have standing to bring such a suit. Your best bet at this point is to consult with an attorney. In terms of costs, what attorneys charge varies. Most attorneys charge on an hourly basis. A few charge a flat fee. You must determine which works best for you.
