Grandparents visitation rights?

my sisters husband killed himself two years ago now his mom is trying to sue for visitation to the children. If she was allegedly charged with murder, do you believe that the judge would grant her petition for visitation? My sisters ex in-laws were very verbally and physically abusive towards her, does this also help her case to keep her childrens best interest at heart?
