Legal Question in Family Law in Texas

My grandsons father has been arrested for felony theft, theft & drugs. Three separate arrests. Court date pending. Is there any way to have his parental rights taken away?He hasn't kept a job for more than a couple months at a time over the last 4 years. My daughter hasn't received child support in approximately 8 months. He is basically worthless.

You need to talk to an experienced family law attorney in your county. If nothing else, visitation should be modified.

Termination of parental rights is very serious and judges don't do it quickly. Also, I assume there is no new man willing to step into his shoes as daddy. Some judges won't terminate unless there is a new man willing to become "legal daddy". Otherwise, if your daughter dies the child will be an orphan.

Not receiving child support for 8 months might not be long enough to terminate his parental rights. Many judges want more time to go by than just a few months.

Also, he might not be convicted of these crimes. He's merely been arrested. He is innocent until proven guilty. I'm assuming that is the argument that his attorney would use to stop the termination.
