What grounds do I have to stand on if my common law wife, we are in the process of a divorce, has claimed both of our children on her 2012 tax return? We share custody of the two children

Make it a part of the divorce situation. If you both claim the children, then the IRS will be talking to both of you as you have just as much a right to claim them as she does.
