Legal Question in Family Law in Texas

my nephew has been living with my mom and with his dad neither one has custudy, she wont sign papers. They are afraid to get a lawyer and lose him. She see's him once a year. My mom would like to get medical help for him and can't, because she doesn't have the right and neither does my brother. The child has been with them for five years now.

If I read this correctly, your nephew is living with his dad. The dad needs to get a good family law attorney and file for custody. If the mom doesn't show up but once a year and hasn't been supporting the child, it shouldn't be that hard.

Then obviously someone needs to shake loose the shackles of fear, and do something for the child. Are this "mom" and "dad" going to just stand by and do nothing? Then nothing will happen. Or perhaps the child could possibly be taken from them so that somebody could properly care for him.
