guardianship case tring to remove mother from stepfather

a guardianship case trying to remove mother from an abusive step father. mother is in nursing home with step father who does not allow us (5 children of hers ( not his)to visit her. now have visitation rights. case is almost 1 1/2 years old. anixious for outcome. there is property involved which was hers prior to the marriage of 32 years. why nothing done earlier?, mom would not allow us to. "i will not become a burden to my children!" what happen to her rights and the rights of her children?

would like to know knowledge of prior cases and the outcome.

Guardianship is a probate question, not technically a family code question. You should get an attorney who is familiar with guardianships in your area. You could protect the separate estate, but step-dad may qualify as mom's guardian. You have a problem that you should address in less than 1 year.
