Legal Question in Family Law in Texas
Handicapped Sibling
I have had my handicapped brother living with me for several years. Soon he will start getting social security, is there anyway to keep other family members from taking him from me at that time? He is ''Educable Retarder 3rd grade level''.
Thank you so much, Lana

Re: Handicapped Sibling
I would really need more information in order to more fully answer your question. How old is he? Where are his parents? Are they deceased? Without that information I will give it my best shot. It would probably be best if you were appointed his guardian. This means you would need to hire an attorney to file a petition to establish a guardian. Through this process you could request that you be appointed his guardian. I am assuming that he is over the age of 18. If he were under the age of 18 you would still need to contact an attorney but it might be easier to file a different sort of lawsuit. Once you were appointed his guardian then you could make certain that the SS benefits went for his care.
Best wishes.
