Legal Question in Family Law in Texas

Health Insurance & Child Support

I am filing for divorce. My husband is already living with his new girlfriend. I wanted to find out if I would be entitled to receive child support for my children through their college years. My son graduated from high school this year and is 18 but will be attending college this fall. my daughter is 15 and will attend college once she graduates high school. Also, would he be required to provide health insurance till that time on both children?

Re: Health Insurance & Child Support

Basic child support guidelines do not require support beyond 18 years or high school graduation, whichever occurs last. (unless the child is disabled).

College education, however, is frequently a negotiating point in resolving support issues and property division issues. You will want to address that with your attorney, and during mediation.

support for college years might be successfully negotiated in light of your soon-to-be X's poor choice of living arrangements. This would require the dedicated services of a quality family law attorney. Good Luck
