Health insurance coverage

I have recently remarried and have two children from a previous marraige. Can my current husband claim my two children under his health insurance plan although he has not adpoted them legally.(he is a city employee so he does not pay a premium)? What legal right does he have as their step father? Is he considered a legal guardian by our marriage?

He could probably list the children as dependents and obtain medical insurance coverage. He has no legal rights in the children. He is not a legal guardian; that is a label given by the court after petition and hearing.
