Hello:

I have recently filed for a divorce, and after the fact my wife has asked me to give up rights to our child. No my question is can she file for a divorce after I have already filed and am waiting for a court date? Andcan I add the relinquishing of my rights to my divorce that I have filed. So far it is an Original Petition for Divorce..

She can file a counter-petition for divorce.

If you don't have an attorney, you need one.

Relinquishing parental rights is just NOT that easy to do in the State of Texas. You can read attorney replies on this website and my www.avvo.com. I don't know what county you live in but quite frankly relinquishing parental rights in rare. Judges want both parents to financially support their children UNTIL a new "daddy" is willing to step into your shoes! If there is no new "daddy" I doubt that a judge will terminate your parental rights. Just because "mommy" wants you to go away, does not mean it will happen!
