Legal Question in Family Law in Texas

Hi,

My girlfriend and I have a year old son. We have been living together since Jan 2009, and he was born in Jan 2010. We are thinking about going our seperate ways, but are having a issue regarding custody and child support. She feels - that because she is the mother - she can take the child, and I will have to pay child support. What can I do? Can I have split custody, joint custody, or full custody? He is living with us both now...until we go our seperate ways

You really need to sit down with an experienced family law attorney and discuss all of your options.

In Texas, it is presumed that joint custody is in the best interested of the baby.

However, joint custody does not mean that you won't pay child support. It also does not mean how much time you will see the baby. Often with a 1 year old, you will not get any over night visits with the baby until the baby is 3 years old - unless you both agree to it.

I highly recommend that you sit down with an attorney and discuss your options.
