Legal Question in Family Law in Texas

Home insurance claims after divorce

Due to a black mold claim on the marital home, divorce has been finalized but home has not sold. The insurance company has stated that the home is currently unliveable. The divorce decree states that both parties must split the cost of the mortgage until the home is sold. The wife is currently living in housing being paid for out of insurance monies. Since the mortgage is being split, should the displacement/insurance/rent money be split? This was not addressed in the divorce decree.

You should check the provisions of your divorce decree. Usually a well-drafted decree includes what is called a clarification provision with gives the court continuing authority to issue clarifying orders for any ambiguities which arise.
