getting home loan when separated

I owned a home before we were married (still paying on a mortgage) and need to get a home equity loan. This is a community property state, and we are separated (filed separate on taxes also). Does he still have to sign for me to refinance my home even though we are separated, but not legally divorced?

The bank will most likely not refinance without your husbands signature.
