House Abandonment

If a spouse moves out of the house, would that be considered abandonment of the house?

If so; if the spouse that moved out of the house continued to pay the mortgage and utilities, would that as well be considered abandonment?

Neither situation constitutes abandonment. Many times when a couple split up -- one of them moves out -- that is not abandonment, just separating while working out the details of the property division.

Some circumstances can give one party an unequal division of the property, under the totality of the circumstances however. The only way to resolve your questions is to sit down with a family law attorney, with all of your debts and assets, and negotiate a settlement. If that doesn't work, then the court will make the division of property.
