Legal Question in Family Law in Texas

The house and finances

He left me and my son (age 4) on yesterday and he took care of the finances. He left a letter saying he's been cheating for 2 yrs. What can I do about the house if he doesn't return, but we're not talking divorce. He won't answer my calls, so we're not talking about anything. Do I move out of the house? Can I rent the house out? I can't afford the mortgage payments. The house is in both our names. What could I do about the house?

Stay in the house and file for divorce now. You might also get a TRO to prevent him from stopping payments on the house so that you can take of his child. Don't wait. Do this tomorrow. If you decide you want to get back together later, see how that works out. But, don't put yourself on the street with nothing to take of the child.
