Legal Question in Family Law in Texas

Hubby blocking real estate payments with threat of lawyers

I lived in Texas, where my husband currently resides. We jointly own two properties in Texas, both purchased after we married. One of the properties is currently being sold on a land contract. The monies from that sale are currently being sent to the realtor who handled the sale. I moved to Michigan in January of this year. My husband has convinced the real estate agent who handled the sale of the one property to NOT send any monies to either of us, as he has, according to him, ''gotten a lawyer to get the property put into his name only''. He has told mutual friends that he is able to do this because ''he doesn't know where'' I am. My question is, is there anything I can do to ensure that he is not, and can not, manuever me out of my interests in these properties and possessions? Is there anything I can do to get the payments released?

You didnt mention if a divorce had been filed, is pending or was final. That will have a major impact on the answer to your question. Assuming that there is no court order that addresses the property in question, you need to send a written letter to the relator (fax would be best) telling him of your address and getting the name of the title company handling the deal. Also, send them a written letter by fax instructing them to send your half to you directly. If you havent filed for divorce, you should also do that quickly. We could get a tro order preventing husband from running off with the money. YOu can still file in Texas based on your husband's residence here. I suspect the MI wont have jurisidiction yet. Call me if I can help.
