my husband abandoned us and left the city to live with his girlfriend (married with 3 kids just left her husband this past month) since march. we have not filed for divorce waiting on him to sign papers and pay cost. I have two children 8 and 5. He wants to take them for two weeks end of july. He has not paid a penny to me since he left us and I dont have a job. we had to move in with friends due to he left us with no money to pay our rent house. Do i let him take my kids for two weeks with no divorce custady papers? i want them to see their daddy but what if does not bring them back so close to school

You need an attorney.
Your attorney will file for divorce and should have a hearing within two weeks. At the hearing, a judge will give you a possession schedule that you can enforce if he does not return the kids.
If you cannot afford an attorney, try the legal aid organization in your town. Your local bar association can give you the number.
I would wait to give him the kids until I had an order, but only if I was working to get an order quickly. The judge will not like you keeping the kids from him for very long and that could hurt you at the hearing.
