Legal Question in Family Law in Texas

My husband would like to adopt my daughter whom he has raised since she was born. Her biological father knows of her but is not on her birth cerificate and has seen her once and is unwilling to pay child support. Could my husband adopt her without the biological consent? And if the biological father fights it can he win?

You would file a petition to terminate the biological father's rights AND for adoption of the child by the stepfather; it's all done in one petition. You don't need the biological father's permission. He can fight you if he wants to, but under the facts you indicate, he won't win.
