Legal Question in Family Law in Texas

my husband was arrested yesterday for a failure to appear for child support. He has not been able to find work so is behind. He is being a stay at home dad right now for our three kids one of them being special needs. How much time are we looking at till he can come home?

It depends on the judge.

He was "arrested" on a capias because he didn't go to court earlier when he was served with a show cause order that required him to go to court. That was a big mistake.

At the hearing, which will happen soon, the judge will decide whether or not to give him jail time. The amount of jail time depends on the judge. It may be as much as 180 days or more.
