Legal Question in Family Law in Texas

My ex husband is on child support for our 3 daughters & has visitation rights. I am concern about the safety & well being of my children when in his care. They have come home with burns, ringworms, hungry, & one incident where I had to report to CPS because they were lock outside for a long period of time unsupervised with no water in 100 degree weather. A few months ago he attempted suicide & had to hospitalized. I always took them to him on his weekends & he has only came to pick them up maybe about three time in the past few years he has been on child support. After the suicide incident, I never took my children back because I dont know if he is mentally stable to care for them. I have allowed him to come to my home & visit but he has only come twice. I even got them their own phone so they can communicate whenever they like. I do not want to get in violate the court order by denying his visitation, not that he has tried to get them anyway but what do I do if he does & or even if something ever happens to me & they go under his care? I do not think he should have custody or unsupervised visits with him & his own mother agrees.

You can probably keep doing what you are doing and be fine. But to stay in compliance with the court's order, you need to try to get the court to modify the order. That would require you to file a petition to modify the parent-child relationship and ask for supervised visits or very limited visits, say 10am to 4pm every other Saturday.

Good luck!!
