Legal Question in Family Law in Texas

My husband has 3 children from his first marriage. His oldest is 16 and always lived with her mother. Recently, she had been skipping school and going to her boyfriends house. After being caught 3 times, her mother kicked her out and contacted us to come and get her, which I did that day. How long does she have to stay in our custody before we become her custodial parents? Legally, I believe the ex-wife still has custody, but she does not wish to return to her mother's home. Do we need to hire an attorney?

You'll want to file a motion to modify custody right away. In the motion, ask that child support stop as of the date the daughter moved in with you.

If you feel like it, ask that MOM be ordered to pay child support to YOU, starting with the day the daughter moved in with you.
