Husband wants custody for alleged cheating

My husband and I will be going through and ugly divorce and he wants custody on the grounds that he says I was cheating. The only bad evidence he has against me was that I was caught in the back seat with another man by one of his fellow officers who will testify for him. We were fully clothed and we were not having intercourse but it definately looked bad on my part. My daughter is one and should be with me but because he is a cop in a small town I am afraid that he will get her. I work very hard and am in no way unfit as a mother. I did admit to my mistake but I was honestly not having relations with the man though it will be thought to be. My question is can I file for divorce in another county because of the conflict of interest as an officer? And do you think he will get custody?

You have to file in the county where you live. What will the guy say who was in the back seat with you? Would his truthful testimony overcome the cops lies? You r situation shouldn't result loss of custody, but we know how lying cops stick together.
