Legal Question in Family Law in Texas
My husband and I are going to try and get custody of his son from another relationship. We live in Texas and the mother lives in South Carolina. Do we need to retain a lawyer in Texas or South Carolina?

How long has the child resided in South Carolina? If the child has established residence there, then your lawyer needs to be in South Carolina. Although you can file the case in Texas, the mother would probably get it moved, and then you have spent time and money unnecessarily.
