Legal Question in Family Law in Texas

My husband & I want a divorce. I am pregnant with another man's baby. Is there any way that we can get a divorce BEFORE the baby is born?

A court cannot issue a divorce until after a 60 cooling off period which begins on the date of filing. You cannot get a marriage license until after 30 days from the date of divorce.

These periods are the only things that might prevent you from being divorced before the baby is born.

In Texas, most courts don't want to bastarize a baby. Therefore, it is difficult to finalize a divorce when the woman is pregnant.

The 30 day remarriage period can be waived if the proper paperwork is submitted and the Judge agrees to sign it.

You need to meet with an attorney face-to-face.

I am not accepting new contested cases right now. I highly recommend that you contact PATRICIA BUSHMAN at 713-807-4905. Talk to Jessica in her office. Please tell them that FRAN sent you.

Good luck!
