Legal Question in Family Law in Texas

My ex husband and I divorced back in 2007 and he still has not taken my name off of the house. He is struggling with the payments and it is affecting my credit. Is there any kind of legal action I can take to get him to do it? We did the papers ourselves for the divorce. I didn't know I could give him a set time limit in the papers to get my name off it so there is nothing in them about it.

This is one of the terrible pitfalls of not hiring attorneys to do your divorce for you. At this point, you are going to have to hire an attorney to file a petition with the court asking for a forced sale of the house through a receiver. The court may or may not grant your petition. If the court DOES grant your petition, you might end up with problems getting title insurance if your ex opposes the sale of the house. HOWEVER, if you do have problems with the title company, just go to another one. Their willingness to insure title where sale was not agreed to is very spotty. Title companies that have not been burned by this before might still take the risk.
