Hello, My husband and are currently involved with cps. We have three children. We are working services and just waiting on time to pass for our children to come home. One problem is my oldest daughter is not biologically my husbands. He has supported her financially and physically since she was three months old and they are very close. She is 3 yrs old now. Her sperm donor was located and contacted by cps because of her. I never put a fathers name on her birth-certificate. He knowingly abandoned me when i was pregnant and not once tried supporting her. Is there anything i can do to keep him away from her. CPS ran a background check and his criminal and cps history are clear. I know he has a problem with drugs and alcohol. What can i do now to keep him away from her. My husband wants to legally adopt her. Our cps case has nothing to do with drugs or alcohol with us. Someone got mad and made false report but of course cps is making us work services and we have been fully co-operative with cps the whole time.

Since you've located the biological father, you can file a petition for termination of his parental rights and for adoption by your husband. A lawyer will charge you at least $3,000.00 for this.
