Legal Question in Family Law in Texas
My ex husband and I have joint custody of our kids. He has traveled most of the past 16 months overseas, so when he was in town I tried to let him have the kids as often as possible, although he didn't always take them.
Now he is no longer traveling, however, I continued to be open to the kids visitation with him at any time. He moved his girlfriend into his home from overseas.
Now, he's already given me weekends that he will not take the kids when it's his possession period even though he is no longer traveling for work.
We have a major lack of communication now and it has caused tension between us. Lately, we fight over the kids and when he will or won't have them.
Because of this, I told him that we should follow the decree for possession from now on. He got angry with this, called me derogatory names and now has told me "he could f* my life up at any time if he wanted to". He also told my kids that "he could make my life miserable any second he wants to".
Is there anything I can do legally for his threats? I know there is a children's bill of rights, and he should not be saying things like this to our children. But what can I do to make the threats stop.

You need to talk to an experienced family law attorney. There is not enough room in this email to discuss all of your options. Please don't call me because I only mediate these days. It appears that you are not in Harris County.
If he is making "terroristist" threats then the police might be able to assit. He would have to make a series of them in order for the police to assist. But, you might want to contact them and see if they can help.
If he is not taking the children and it is costing you more, some judges will increase his child support since you are having to feed the kids more. I've also seen some judges terminate his visitation or make his visitation supervised if his behavior becomes really out of control.
You really need to talk to an experienced family law attorney about your options.
Unfortunately, I don't know of anything you can do to make his threats stop. If I did, I could be a very wealthy woman!
