Legal Question in Family Law in Texas

My husband and I are kinship care givers for our grandson CPS took him from his mother after birth and I've had him since he is now 6 months the father my step son is in prison and is willing to give up his rights but the mother has made no effort to do any thing she is expected to do with CPS and has a history with another child who she has already lost is there anything I can do to speed uP the process and adopt him already?? They gave her ten months but after 6 months of not trying can we just go to court and try to get him?

You now have substantial rights with the child (after having him/her) 6 months. You can sue for custody and/or termination. Where do you live? [email protected]

Yes you can go to court to try to obtain custody.

I agree. After you have had the child for six months you can sue to become managing conservators of the child. This would probably be the fastest option. It is more likely that Mom would agree to this as she would have visitation rights.
