Legal Question in Family Law in Texas

my husband and i were married in Feb last year. He is now in jail for sexual assault, i found out before he married me he was with another woman, living with her for seventeen years, now i am wondering if there is a marriage at all. Is there not informal marriage in the state of Texas.? They had three children and cohabitated for the full seventeen years.

There is informal marriage in Texas. However, if they never filed an declaration of informal marriage, then on the second anniversary of his moving out, it is presumed that they were NOT married.

You may want to file for divorce just to clear up your marital status.
