Legal Question in Family Law in Texas
My husband and I married in June, 2004. I left him in October of 2007. We lived in Texas, but I currently live in PA, he is still in TX, and he is in the Tarrant County Jail at the moment, waiting a court date where he is supposed to get sentenced anywhere from + months to 2 years on drug charges, which is why I left him.
We are separated with no hope of a reconciliation. I want the divorce.
However, I just recently found out that he had a second wife (I was his 3rd wife....and thought I was his 2nd) and our marriage may not be legal because his 2nd wife has told his grandmother that they are still not divorced.
We were married in Pennsylvania and he provided his Divorce Decree from his first wife at the time. I didn't know he had a second wife. He had married the 2nd wife in Texas.
What can i do about this? Please help!

You would file a suit to have your marriage to him declared void. It's covered by section 6.202 of the Texas Family Code.
