Legal Question in Family Law in Texas

Can it be done?

My husband and I have been married for almost 4 months now. We both work full time, and we want to try to get custody of his 10 year old daugter.

Our problem is that my husband was in jail serving a 10 year sentence, so his rights were taken away from him. I believe the crime was aggrevated kidnapping and robbery.

The child is now living with her grandparents who are both in poor health.

I do not know whether I should move forward by contacting a lawyer or if I should leave things the way they are now.

My question is ''Is there away my husband can get his rights back in order to get custody of this wonderful child.

Bluntly, probably not.

Where is the child's mother?

Grandparents may wish to work with the dad to make arrangements for conservatorship.

Retain an attorney for a consultation -- there may be an alternate-type option.

I would respectfully disagree with my learned colleague, Ms. Langford. If your husband is gainfully employed and rehabilitated from his former felonious ways, the test is - what is in the best interest of the child. So, if the grandparents have the parental rights to the child, they could relinquish the rights to you and your husband for an adoption. Stranger things have happened. There may be options in this process, so I do agree with Ms. Langford that you should consult with an attorney. Good Luck.
