Legal Question in Family Law in Texas

My husband and I have been married for 2 years and have a 2-year-old son together. I have a 5-year-old son, from a previous relationship, that we would like for my husband to adopt. The biological father has not been seen my son in over 3 years and when he did it was only 6 times in 2 years that he saw him. He owes over $10,000 in child support and has not made a payment in 1 year. The bio-father and I went to court when my son was about 1-year-old to establish child support and paternity. At that time my sons name was changed from my last name to his but still today, 4 years later, the bio-father has not changed the name on the birth certificate; it still shows my son has my name.

How would we go about getting his parental rights terminated and my husband to adopt my son?

Adoptions are complex. Here the big problem is getting bio-dad to relinguish parternal rights.
