Legal Question in Family Law in Texas

my husband moved in with his parents,put all furniture in storage and left me and my son to get a house with no furniture or dishes.as long as im his wife do i have rights to these items until divorce

How sad that in the holiday season that his son is doing without!

I assume the "stuff" is community property.

If so, yes it's yours.

However, I don't know how you are going to get access to the "stuff".

Perhaps you have someone that he respects that might be able to talk some "sense" into him. That would certainly save both of you a lot of money in legal fees.

I find that people that are getting divorce seem to initally behave badly. After paying a lot of money in legal fees, they eventually return to their right minds and recognize that they are only hurting themselves and their child. Unfortunately, it's usually only their have spent a lot of money. Perhaps you might be able to find someone to explain this to him easily in the process and avoid spending a lot of money!

I suggest you contact a family law attorney in your county and file for divorce along with temporary orders.

The judge will ORDER him to give you access to the "stuff". I doubt that a judge will think kindly on his behavior! Pehaps even order him to give you some money for this sort of behavior.
