Legal Question in Family Law in Texas

My husband had a one night stand 5 years ago with a woman before we met. She is now claiming that my husband is the father. She wants money. Of course, we want a paternity test done. She of course wants this too. Now all of a sudden the child is in Mexico with her grandmother and we will just have to wait. We have decided to text all our conversations so that any attorney or the ag if it goes that far can see what she is doing. We believe that she is stalling so that she can collect BACK child support without letting my husband get his visitation now with her. She continues to threaten us with going to the ag and then turns around and sees she just wants the best for everyone. She is not trying to cause trouble between my husband and me. That is rediculous, that is exactly what she is trying to do.

My questions are if we can prove that she is the one reluctant for taking a paternity test, is my husband still responsible for back child support?

(We are hoping that this child is not his.)

What can we do or what should we do to end this matter without going to the ag ourselves which is going to be very costly?

(My husband does not make much money.)

"Going to the AG" won't cost you anything.

If this man is the father, he will be ordered to pay child support (or he can try to get custody of the child, and ask the Jude to order Mom to pay HIM child support).

Ignore this woman, stop talking to her, and don't take her seriously until you get served with a citation. Just shut her out, and don't let her upset your lives. I think she's a fake.
