Legal Question in Family Law in Texas

My ex husband has been in prison since 2005 and won't be up for parole until 2015. (This is his 3rd time in prison in 7 years.) My current husband wants to adopt my daughter, but my ex refuses to sign the papers. He is in IA and we are in TX. Do I need a lawyer to file for abandonment? Any suggestions would be helpful. Thank you!

You will need to file a Petition for Termination of Parental Rights. He will be notified, and will have an opportunity to oppose the petition. It is then up to the judge, but you have a strong case.
