Legal Question in Family Law in Texas

My husband and I are separated and soon to get a divorce. He is not responsible enough to pay child support for our two children right now whom live with me. Their ages are 12 and 13. Is it possible to have child support taken out of his check right now or do we have to go through a divorce before that is possible?

Yes, you can do it now, but you have to ask for temporary orders, and have a hearing (this happens while the divorce is pending). The result of the hearing is a temporary order that requires the payment of child support. The temporary orders will also provide for wage garnishment.

Some divorces take years to finalize. Temporary orders are a good idea.
