Legal Question in Family Law in Texas

My husband and I are separated, and have a two year old daughter and a 2 week old son. We had a paper signed and notorized regarding our daughter. It states that her primary residence is with him until a court mandate is set and that I will recieve visitation every wednesday and every other weekend. Is this document a legally binding document even though we did not appear in front of a judge? I'm concerned for the well being of my daughter and want to make sure that it is not illegal to keep her from her father since I signed this agreement.
