Legal Question in Family Law in Texas

My husband wants to sign over rights to his daughter who has been in his mother's custody for the past 3 and a half years because we can no longer afford child support as we have a one year already and will soon have another child. If he terminates his rights is he still obligated to pay child support?

You can talk to a family law attorney but it's not likely that a Texas judge will terminate his parental rights just because he wants it done.

It is the obligation in the State of Texas for both parents to support their children. Even if the parent does not visit the child, financial support is expected. The Texas Legislature passed this law.

If you have 2 other children, then you can ask the judge to reduce his child support.
