Legal Question in Family Law in Texas

My husband signed a waiver of citation but in the state of texas the judge will not sign the final divorce decree until 60 days after the suit has been filed. Can my husband resend prior to the 60 days and try to contest the divorce?

Yes.

Read the waiver. Most waivers waive only the husband's right to be served (and the waiver may also say that "this cause may be taken up and decided without further notice to me"). He can change his mind tomorrow and file an answer and a counter-petition, and pay a jury fee.
