Legal Question in Family Law in Texas
My husband and I had temporary guardianship of his younger brother, age 14, starting Dec 29, 2010. We had a signed notarized paper, with no specified end date, that their mother prepared but it did not go through the court system in Indiana where she resides. On June 29 she came to Texas to get him back. He wanted to stay so she contacted the Constables who said that we would have criminal charges filed on us if we didn't require him to go with his mother. The younger brother is currently in an abusive situation at home in Indiana. CPS has been contacted. Is there anything we can do to get him back to Texas where he wants to be? Thanks!

If CPS initiates removal proceedings in IN, you can file an intervention through an attorney in IN and will have a good chance of getting him back, if there are no other blood relatives in the area who can take him.
